California Woman CLAIMS Sephora Lipstick Sample Gave her Herpes

A California woman is suing makeup franchise Sephora to the tune of $25,000 for giving her oral herpes at a Los Angeles store, according to court documents retrieved by the Daily News.

Elena Davoyan, who filed the suit Thursday, claims she applied a lipstick sampler in October of 2015 and was later diagnosed with oral herpes. She says she’d never had herpes or a cold sore before the visit. Now she is suing for liability, negligence, intentional infliction of emotional distress and negligent infliction of emotional distress for an “incurable lifelong affliction.”

She wants others to know the dangers of trying communal lipstick samplers and says Sephora doesn’t adequately warn their customers of the danger. The lawsuit states that the store encourages “common use” lipstick use by having “shelves and shelves of open lipstick tubes” and pads to wipe the lipstick off. Davoyan says that other stores use “lipstick wands or swabs” or have individual tubes to make it more sanitary.

“The bottom line is that (there) are numerous simple solutions to prevent the spreading of diseases through lipstick testers, and that is Sephora’s responsibility,” the lawsuit filed by lawyer Robert Krasney states.
